The practices charged by the EU have already ended.

"Regulators said Intel's abusive behavior started in 2003 -- two years after the EU opened an antitrust probe triggered by an AMD complaint -- and went on for approximately three years"

The EU complaint is about past conduct that ended in 2005 or perhaps 2006 not current conduct. When the questioned occurred AMD was gaining market share. Now that the practices have ended AMD is losing market share and operating at a loss.

"In the EU's view, the problem is pricing, not market share."

The EU thinks that discounts that produce lower prices for the consumer are bad. Screw the consumer says the EU, we have to protect the German company.
