Thanks - that is an illuminating case because the CEO pumped Whole Foods and bashed the company Whole Foods was trying to acquire...now that is manipulation ; however, in order to show the market was manipulated, that is a hard burden of proof don't you think?; maybe if the company's stock dropped with every bash but so unlikely. In order to sucessfully prosecute it must be on some strict liability theory and of course if the CEO posted inside information that is material and likely to affect the share price. Thanks
