lifegear: They didn't. They attempted to sue the SEC based on their NSS claims, and their claim that the SEC is responsible for what happened with NSS.

The florida court threw out all of RA's complaints, some with prejudice (can never be refiled), the ones seeking financial recompense from the SEC, and some without prejudice, which meant they could be refiled, but they only had until April 2005 to do so. Those were the charges against what RA was identifying as the 'John Doe's' that supposedly were the NSS. In order to file those charges again, he needed to identify the 'John Does' by name.

RA did appeal. The appeal was lost.
