And if he made the 65 cent claim it was a no-no as that is a very forward looking statement.

Now if he made it knowing that the deal was not going to happen then he has violated the law.

And it is not unheard of for a penny to givve one investor information but not others in hopes that he may tell his friends and a small group create enough buying pressure to move the market and then it would bring in other buyers.
