The firmware upgrade has alledgedly been sent from edig to the oem or gateway or whomever. The battery issue is related imo to cost of manufacture and 80 bucks isnt that bad imo, especially when it will probably last 18 months or so (judging by the i-pod).
Lots of unknowns here but that is usually the case. I for one dont think gateway is going to do anything detrimental to customer satisfaction/
