I covered a horse neglect case about five years ago. The SPCA visited at least 3 times before finally taking the animal and charging the owner.

The investigator I talked to - and I called him again yesterday to double check my thinking and to give him a hypothetical - said usually immediate removal the animals and charging of an owner (I asked if it could happen on the first visit) happens if the animals are near death's door, and in incredibly bad shape.
