Can someone answer 2 tax rule questions?

I xferred $500 of a stock to a friend's new account and he gave me $500. 1st question: Is this legal?

What if he sells it when those shares are over 1 year old, but he has only had them for 6 months? 2nd question: Is it short or long term gains?
