The License Agreement that you cite says that all patents filed within the Capture Period of the 10th anniversary of the Agreement. Patents filed more than 10 years after the start of the License will not start to become patents until 2 to 3 years after the 10th anniversary.

The practical effect is that the License provides patent peace for 10 years until January 1, 2011 plus the several years it will take for AMD and Intel to reload their arsenal of patents.

Any new Agreement that replaces or significantly changes this Agreement would require another SEC filing by AMD. So what you see is what you get.
