In order for that statement to ever be true, QUALCOMM will have to have every single one of the numerous patents in GSM, WCDMA, and CDMA that Nokia has declared as essential to those standards either invalidated or declared unessential by a court or agency qualified to do so. Barring that, without a license from Nokia for those essential patents, come April 9th, QUALCOMM is willfully infringing those patents.
