The Genta and Allos ODAC meeting on 5/3/04 was the tipping point for the new strategy. Once they saw that Pazdur was going to impose his will on development-stage biotechs without McClellan around to rein him in, they doubled down, and the new hedge funds that have been formed since mid-2004 also use this same strategy of shorting development-stage bios.

This strategy has been validated so far judging from all the Phase III blowups, with only a few exceptions.
