Cabos, I have to respectfully disagree with you on no contest being an automatic guilty. At that time that Rich plead no contest, if the judge really thought he was guilty, he would have adjudicated him guilty. What the judge did instead was to withhold adjudication with the condition that the money be paid back. AGAIN...IF THE JUDGE THOUGHT HE WAS GUILTY, WHEN RICH PLEAD NO CONTEST, THE JUDGE WOULD HAVE ADJUDICATED HIM AS SUCH. INSTEAD, THE JUDGE WITHHELD ADJUDICATION. Did anybody ever consider that Rich might have agreed that the client was owed the money back and that is why he didn't contest? I don't know this to be the case but am throwing that out as a possibilty. Personally, I'm getting rather tired of this discussion. I hope if I'm ever faced with any legal problems you all aren't sitting on my jury. You seem very quick to form opinions without hearing the facts. SH
