Any suit that Phoenix doesn't win they could tie up in court for many years. In those years Phoenix would dig out the pit and in the end make all the money. The worst case scenario is they lose the bond, now if they win like I think they will we would have the same deal without losing the bond. Also, if EH Mitchell did win they would be responsible for every upgrade Phoenix made to the pit while they where working it,,, and thats the law....Phoenix wins no matter what and thats why they are loading the pit with new equipment.

The second lawsuit is directed towards damages by Phoenix to the pit owner and his lawyer. We win that we win money but I would expect an out of court settlement. Phoenix has a superior legal team and advisors on this matter. EH Mitchell will come to its senses and settle.
