I am not a legal scholar, but this is my understanding.
An appeal has to be done in an appellate court.
So, Lamberth's case has to be closed before an appeal can be filed.
Whatever Lamberth's ruling is, either party has the right to appeal in an appellate court.
So, look at what is happening. The parties wasted a good 4 months after the verdict to figure out the interest rate and payment schedule.
That work is all wasted, because the payment schedule expired in January. Now waiting for a motion to overturn.
In my opinion the parties are giving the government more time to resolve this issue. So, nobody has to rule.
