Absolutely correct, he fired no shots, therefore there was no assassination attempt, but he is being with gun violations. Simple as that, The one in Butler, Pa was an assassination attempt and this one was not. He may have had the idea in his head to shoot Trump, but never fired a shot at him....... Even if he said he was going to shoot Trump, until he pulls that trigger, there is no assassination attempt, just threats....
