Yes but also need to be SEC filing current. Form 10 is effective after 60 days, if I recall correctly. So in theory FBEC could they file Form 10 along with whatever other filings needed, and that gives them a 30-day window to get the SP up above .01 and then maintain for another 30 days, then they could qualify for OTCQB? My guess is OTCM would label them pink current soon after a Form 10 - it would not take 60 days to get pink current status. There are numerous examples of SEC filing Pinks, as well, if I'm not mistaken.
