Stokd NLST I wholeheartedly expect—rarely if ever I provide predictions or pretty sure of something—Gilstrap will deny Samsung motion to stay & vacate 463 judgment till CAFC appeal on all patents in the case are concluded. If you read it—thanks again to whoever made it public which makes it easier to address/discuss—you will understand why.

I wasn't going to address or post about this sur-reply, given the substance was already contained in the motion itself and Netlist's first response in opposition. And with the BOC trial within days, wanted to stay focused on the immediate. And at this point, the back and forth rearguing of a motion is just noise to me... all I'm interested in is Gilstrap's decision.

Last night there was also some docs filed in BOC case—more noise by Samsung—their objections to Netlist's recent motions for subpoena power and accurate Korean translations. And another proposed jury verdict form with parties competing versions. It'll play out with trial in days.
