They may have a few patents tucked away, but the best patents they had were used in the lawsuit, which was lost. So there is no path forward with litigation regarding patents. Its costly, time consuming and the patent landscape has changed.

Well stated - a merger is the last chance at turning this around. Any entity seeking a merger, will of course capitalize on the dire circumstances WDDD is in, so the merging entity will get favorable terms, not fair market value for WDDD.
