The court system in this country is a total clown show. On one hand we have criminals running wild all over the place, on the other we have a case like the one with WNFT which should take a 5 year old 10 minutes to decide, but instead we sit here and watch a solid merger candidate tank 95% while the court does something I can't say on here. what a clown show! No wonder nobody respects the so called judiciary!



Ironically, a five year old with knowledge of the law would rule against WNFT. The clear precedent is Callie v. Bowling, which:
A) didn't care that the appellant wasn't a named party, and
B) ruled that the court never had jurisdiction over the property in question, which is exactly what happened here.

As there was no personal service or service by publication, the court never had jurisdiction over the shares that it canceled. Easy peasy, five year old logic reaches the straightforward conclusion.

But you are correct, if the court system moved faster and that was resolved immediately, Sharp could have decided whether to reach an agreement or abandon WNFT and the process would be accelerated for shareholders.

The truth is never popular.
