Spyke37, both of your most recent posts are very well stated, and I could not agree with you more. Today's pps is virtually meaningless, and once VPLM gets on the radar of the larger investment community, we won't likely see buying opportunities like this again, in my opinion. VP is well poised for a successful trial outcome, which will do more for the share price than an out of court settlement. Talk about NDAs, an out of court settlement would be rife with them. Plus, an out of court settlement may not be the catalyst needed to bring the remaining infringers to the negotiating table, precisely because "infringement", although alleged, will not have yet been proven in a court of law. As far as treble damages are concerned, this punitive award is not as commonly applied in infringement cases as one might think, because it has to be proven that the defendant knowingly and willfully infringed. The defendants could always argue that until the patents were upheld via the IPR process at the PTAB, it could not be ascertained that those patents were legally valid (perhaps a lame argument, but it could influence a judge to give the benefit of the doubt, and deny treble damages).
Nonetheless, I agree that VPLM's best days lie just ahead. GLTA.
