Simply because VPLM attorneys tell VPLM board what not to do, not someone else's attorneys. Why they instruct the board so is another question, something I don't know. Perhaps part of their tactic / strategy "not to litigate in public". VPLM lawyers most likely are not concerned with where PPS is at any given time until the end of the trial / settlement / buyout.
