At another preliminary hearing Monday before Engman, Mark Thompson, 63, of 418 Gompers Ave., Indiana, Pa., had a single charge against him bound to court.
Thompson faces one count of criminal solicitation-theft by unlawful taking, a third-degree felony.
According to the criminal complaint, on March 27, an employee of Prime Energy — which owns the Swamp Angel Lease, an oil lease off U.S. Route 219 in Lafayette Township — found an excavator on the lease property. He contacted the owner of the excavator, who explained that he was allegedly hired by Thompson to load about 27,000 feet of pipe onto a flatbed that Thompson was selling to another company.
The Prime Energy employee explained that Thompson did not own the pipe, and the excavator owner agreed not to move the pipe until there was an investigation.
Prime Energy owner Russell Parker told Lewis Run-based state police that Thompson does not own the property or any equipment on the property, according to the complaint.
“Parker related that Prime Energy and himself have had issues with Thompson regarding this property,” court records stated. “Parker provided documentation which displayed ownership of the Swamp Angel Lease and recent court agreements regarding this property.”
The excavator owner provided to police an email showing a wire transfer of $11,250 between Thompson and Central City Steel Inc. — the company to which Thompson tried to sell the pipe.
Thompson is free, having posted $250,000 bail.
