No mistake at all. Fernandez cleaned up all the convertibles, put a ton of cash into the company. Fernandez has "owned" RXMD for some time now by virtue of his share count and the fact that he is the CEO. Do you really think that he would let a 40 million dollar revenue company with huge upside go by the wayside. I tend to doubt that. He only benefits from his investment if RXMD is able to see fair market value.
