DOE was a cooperating agency in FERC’s decision, so there is that, but this seems to come with a little more risk now after the recent LNG crackdown and tougher stance on requirements for extension.
The DOE seems pretty intent on not allowing the extension system to be abused.
I’m aware of the positives (i.e. environmental impact etc.) that give them an edge and the limited contingencies they are willing to apply, but it’s never fun when the fate of a company rests entirely on the government doing the right thing.
You just never know with the government. Don’t underestimate their ability to totally screw things up without any care for the consequences.
Hard to imagine them hurting all of these deals and wasted money spent, but they won’t feel it.
I’m pretty positive on extension, but this is do or die for them
