Isn't there a provision in HERA that states "if any part of HERA is challenged successfully, (like the Lamberth case) the whole statute (HERA) must be unwound, rescinded? I thought there was something in there about HERA not being severable for parts challenged. Any legal beagles here that can shed light on this aspect of HERA?
