Where does it say anywhere explicitly that treasury has a fiduciary to taxpayers?



How about Treasury's press release on the day the original SPSPAs were signed. It talks about protecting taxpayers a bunch of times, such as:

With this agreement, Treasury receives senior preferred equity shares and warrants that protect taxpayers.


The Preferred Stock Purchase Agreements minimize current cash outlays, and give taxpayers a large stake in the future value of these entities.



If you want to mince words for the umpteenth time and say that this isn't the same as a fiduciary duty, whatever. Hank Paulson clearly used the term "protect[ing] taxpayers" in that press release to at least include some sense of fiduciary responsibility, including mentioning the minimizing of losses and the potential for gains.
