Can't you read in HERA that it's an amendment of the FHEFSSA of 1992? A law exclusively meant for capital adequacy matters, at the request of a GAO report the year before (Source).

Therefore, it's always the FHEFSSA the law in force and HERA just inserted patches in the FHEFSSA and the Charter Act. You want to conceal what HERA didn't amend.
Although the Risk-Based Capital requirement is outlined by regulation, it's required by law, and thus, the Capital Rule that came into effect on February 16, 2021, called ERCF, is, in reality, a FHEFSSA Capital Rule, and not FHFA Capital Rule.

By the way, the FHEFSSA Critical Capital level is missing in the ERCF, because HERA didn't amend it. They are 3, not 2 capital requirements. Not meeting a threshold called "critical" bothers for the big lie of "rehabilitaton of FnF" peddled by the CEO of Fannie Mae and company, for the release today ($-194B Core Capital) and their invalid capital metric "Capital Reserve" used by the Federal Reserve only (Capital Surplus), badly assessed (adjusted Capital Reserve = $0) by the way.
This is why you want to conceal the FHEFSSA.
