That isn't how it works. Accusing someone of a crime is defamation per se, you are correct. But truth is an absolute defense.

So if I accuse someone of a crime and can point to evidence to support that, I'm not guilty of defamation even if he is never charged with or convicted of the crime.

That's why I said perjury is more opinion, because whether he committed perjury isn't clear without more evidence, but there is sufficient evidence to say that he lied to the court. It may not be a huge lie, he may never be charged, but I can back it up with evidence.

While more serious crimes are more black and white, perjury can be open to interpretation. I can say he lied about having a pending merger because it's been two years and nothing came of it, so it is a logical conclusion to make and I can express my opinion.

The truth is never popular.
