They (Elite) is requesting to delay their case as the family (2 families) of patents are already in court being litigated. Some were already ruled against Purdue and are being appealed. Purdue lost due to obviousness. Meaning it would be obvious to use xyz in abc manner and isn't a new invention or unique application. That's the basic idea. I spent way too much time on this years ago.

Patents "family" means that one patent kind of begats the next. It's how companies protect their inventions. Think of it like a house with a door. And this identifies all the windows you could get in and closes those too. In this case it seems there are two families of patents.

The other trial is mid Feb. Elite is suggesting a 6 month stay since it wouldn't be efficient to run a case with Elite when it's already been litigated (Purdue lost and are appealing) or in the process of litigation. Both mid February I believe.

Note that these trials do not cover all of the patents but about half. (But all from the same family) It is looking like nonsense from Purdue imo but this is what they do and is expected.
