When you clear through Pershing, Merrill and the big boys you have access to short very easily because there is an expectation that in their vast network of accounts, correspondents,IAs and Hedge funds, that the stock is always available. Was Sabby in violation for not doing a locate? yes. However, Im willing to bet there was an expectation that the stock could easily be located and this is why they were shorting. Its not this nefarious NSS that you speak of.
