If it is the distribution only, Lamberth should have ruled long ago. The delay is to buy time to work out a resolution. Think about it. FHFA made mistake (NWS in bad faith) and will need to pay $600M+ compensation. However, FHFA does not have the money. Many think that Fannie and Freddie will pay for it (and they have ear-marked some funds). In law, there is simply no such arrangement between FHFA and the GSEs. The GSEs are victims. May be, they can do it as donation (?) to FHFA. But, that's unrealistic. So, they need something better.
