They didn't change the formula to try to dodge any fees. Battelle's patents expired in 2022, but even if they hadn't the leasing fees were tiny (something like $2k a year). hey changed the formula to optimize the hydrogel component by reducing the polymer production time and increasing the output by a factor of three (see last 10K patent section).

Before anyone tries to freak investors out about the expired patents. Their patent No.1811.191) were ruled as having novelty, inventive step and industrial applicability. Vivos notes this gives them the basis to extend for many years the patent protection for the proprietary Yttrium-90 phosphate particles utilized in both their Isopet and Radiogel products.
