Because it is you who the FACTS escape...
There is no such thing as "winning an IPR". You can definitely lose an IPR but there is no winning... Notice that lord Emu never uses the term "winning" in relation to the favorable IPR outcomes. Never, I don't think. Only "wondering" folks such as yourself. If a company challenges the validity of a patent via IPR and they lose their challenges, they have actually lost something and it costs them in several ways for losing... However, at the same time, the favorable ruling to the challenged patent is simply the defense of, the fending off of and the swat of the fly.....which is not a win of anything, it's merely defense of what you already possess. If the patent owner lost the IPR, that would be a definite loss of alot, ie, loss of validity, but other than that....it's a nothing gained, nothing lost scenario. Upon the favorable IPR outcome, the patent owner has EXACTLY the same attributes as the moment the uspto awarded the patent in the 1st place.
You could say they have "bragging rights", I suppose, esp with the 36/36, but that's just an illusionary thing anyway. Once ceo tom Sawyer, someone with humongous accomplishment, respect and pull, sent those damning letters out to the world that threatened the already established fact corrupt PTAB with very serious Federal RICO charges, EVERY SINGLE IPR against vplm has outcomed favorably. Of course, no other company can claim such a record even tho there are surely some with valid patents as well. But none of them were threatened with fed RICO charges by one of the world's most prominent citizens in terms of public service! Those are FACTS and deserve serious consideration but do not and will not by those like you who wear blinders.
It's also FACT.... that vplm/digi-phony-ca STATED they conducted worldwide (3 cities) validating nodal tests. But as far as I've been able to ascertain, no results of those tests have ever been released or made public. Gee, in my crazy thought process, that is a huge red flag...
Also, to my knowledge, no proof of infringement has ever been established by anyone. That's another FACT!
Of course, the oh so obvious FACT....that if something.....anything.....had the kind of value AND POWER that's been clearly established and attributed to the patents, someone repeat SOMEONE would have the common sense to snatch it up which is clearly far more sensible in several ways to stealing it and using it and making money from it being embedded in their products while at the same time KNOWING that sooner or later they will have to pay a formidable price in infringement damages and aggravated damages and loss of product and loss of competitiveness, etc etc. Not exactly rocket science to realize those truths and FACTS! And to simply ignore all that.....to ignore the nuke missile headed their way with their name on it. INEVITABLE.......especially after seeing for many years now how vplm is totally capable of raising more than enough funds to have the finest defense money (shares) can buy. So for the above delineated reasons plus others, it would be utterly stupid and insane for all the big dogs to let such an ALLEGED massive fortune and power base to sit in the middle of the road. That.....MAKES ZERO SENSE and is totally at odds with human nature AND.....in fact, has never happened in the history of mankind, especially not at such a value level as is ALLEGED! Those are FACTS FACTS FACTS.
There is, IN FACT, no value to the patents other than what the owners and managers have been able to rake in by the veritable truck and boatload, for years, by pimping out THE STORY.....THE FIB.....that was expressly designed to get you on the end of the hook, line and sinker.
So many MAJOR signs of the companies behavior that reveal its attitude and motives.......all ignored and falsely attributed to the good of the owners and the good of the shareholders. So many lies and half truths vplm has put forth over the years and you let them all slide because you don't want to be wrong.
