Regarding Purdue v Elite

Was 100% expected. They will sue everyone on this. I suspect mostly looking for a payout first. They know they will probably lose. I am hoping Elite doesn't take it but it would be expedient.

The idea of doing a deal with Purdue is gross. They should be in jail and the company dissolved.

Regarding the merits of the case. It will be interesting. Elite has a lot of patents in both ADT and time release. Their tech was the patent behind Concerta years ago if memory serves. They sold it to them. Not sure if they retain the ability to use it. I don't remember. It's probably expired anyway.

Elites patents on time release were mainly focused on time release via polymers and the specific characteristics of the ones they use. They narrow the scope to get the patent.

The two bead was another part of this.

That said, they have a bunch more and I would not be surprised if the tech here is different. Truly different on the physical side. Again narrow of the scope.

On a general note how do you sue for something you haven't seen yet? I wonder if Purdue just opened up a bigger can then they know. Because while it's been awhile, Elite has a number of inventions in this space. Anyone that wants to go patent hunting. Have fun. That's a big rabbit hole I don't have time for these days.

Overall impact to Elite is really only that it will cost probably a million dollars to litigate this. Maybe two. But I doubt it. Elite has been expecting this for years. Elites doing $14m a q, probably 20-30 next Q. They are fine for cash

Regarding the impact to the product mix and future revenues. It's a $750m drug. They have $10b in products we know about. So it's 7% of a massive group that we know about.

The wide effect of this is it does make us even more legitimate in the pharma community. And the publicity isn't going to hurt but help to bring more eyes here.
