That's funny. However the facts are even more entertaining.
-The OTCM is responsible for setting forth thier policies..They are also liable for them.
-The OTCM set thier policy about promotion..The OTCM also stated to the company that TXTM or its management did not engage in promotional activity on or before 11/10/22.

So, every day after that the OTCM is liable for damages after admitting they incorrectly applied the promotional tag, yet continued to hold TXTM for another year.
It's as simple as that. Thier policy to go on a discovery expedition looking for other infractions DOES NOT isolate them from damages.
They attempted to use permits to delay, they failed miserably and likely illegally.

Those facts are not in dispute.
You make policy, that's fine, just be ready to pay up when you abuse them.
LAW supercedes "policy"
