Why has there not been a lawsuit to challenge this illegal taking ?



1) "Illegal taking" is an oxymoron. Any taking is by definition legal. Perhaps you meant illegal exaction.
2) Plenty of cases have been filed. To date the only one that has succeeded is the one that the jury awarded $612M to shareholders plus pre-judgment interest on the Fannie preferred class.

Got legal theories no plaintiff has tried? File your own lawsuit or shut up.
