Apple is at it again. Apple just lost a patent case against Masimo Corp and said they will appeal. The CEO of Masimo was on Cramer this past Friday. Masimo is making an elaborate smart phone with diagnostic capabilities which will require FDA approval as a medical device. The CEO stated that Apple had recruited twenty employees from Masimo to work on a similar device. When asked why Apple did not license this technology from Masimo the CEO stated that it was cheaper for Apple to infringe than license (Sound Familiar?). I believe Masimo is likely to seek an injunction at some point if they can not strike a deal with Apple. Real changes to our system need to be instituted to prevent this type of IP theft and willful infringement . the prophet
