It would not have mattered if the CEO had asked the FDA. In fact I am sure he did. But that doesn't change the fact that the FDA can, and frequently will add more tests to get approval. That is because many reviewers are getting paid or will be getting paid by competitors of the product under review. This is no secret. The only thing any company that doesn't have a future job offer in the works for one or more of the reviewers, is to smile and take it. M.K. like any good poor start up company CEO is smiling it and taking it. We investors do not have to smile, but we do have to take it.
