1st we have three party's of representation to consider; ...
Mr Allison and Mr Lupi for Lehman Brothers Holdings Inc;
Ms Hilliard and Mr Roscoe for LB GP No 1; and
Ms Tolaney, Mr Fisher and Mr Goldfarb for Deutsche Bank.
On May 4th, 2023 there's reference to a waiver agreement between ... "waiver agreement between LBHI and the joint administrators" ... that had not been discussed' with the "others" which was in reference to the distribution' mechanics' ... and' ... "the terms of the agreement are such that this so-called waiver terminates in June 2023"
So, if I have this accurately ... ? ... LBHI had set up a "waiver" that would place ALL of the funds' ... plus the accrued "interest" as Hilliard refers to on May 4th, 2023 ... to be held until MR JUSTICE HILDYARD ... hears the final determinations of ALL party's with the actual numbers disclosed coming up here in October, 2023 ...
My opinion is and my conclusions are that, LBHI did the correct thing with the "waiver" placing everything on hold' with the joint administrators' .... the funds plus interest accrued ... due to the fact that Class 10' can not be separated' between the European issue E-Caps (10a) and the USA issued CT's (10b) ...
and if I may add, it appears that the E-Caps were attempting to keep everything, just like rosssssie tried and failed to do with WMI's PIERS' ... and as reference with Judge Walraths precedent setting ruling in the USA's Federal Bankruptcy Court ... the Class ... ie: Class 10, cannot be separated' ...
