Yes, thanks ChessMaster for an important detail. We keep talking about the "loss" at the SC but that's just shorthand for not outright winning. It was partially denied (the exceeded authority claim), partially affirmed (unconstitutional removal of Director) and remanded to lower court for remedy for harm suffered on the removal issue.

At no point did they say the NWS was harmful or not harmful, valid or invalid, a taking or not a taking. They just said FHFA was within it's statutory authority when it implemented the 3rd Amendment.
