Judge Sweeney entered her opinion and order this afternoon saying the Federal Circuit’s decision in Fairholme is binding precedent compelling dismissal of the Fisher & Reid Plaintiffs’ complaint.
Plaintiffs’ Fifth Amendment takings, illegal exaction, and breach-of-fiduciary-duty
claims are not viable because the binding precedent of Fairholme bars such claims.
Accordingly,the court DISMISSES plaintiffs’ second amended complaint, WITH PREJUDICE,
for failure to state a claim upon which relief can be granted
