Hayday, I once felt that Albright's failure to establish new trial dates could indicate that he is giving parties an opportunity to settle the cases. Now I am not so sure. Wouldn't it make more sense to establish trial dates and stick to them? It has always been defendants strategy to delay, delay. and delay some more. They have had more than enough time to settle this litigation and delaying trials seems, at least to me, falls right into their game plan. In fact, keeping the trial dates is the only way I see of bringing these defendants to the bargaining table (settle on the Courthouse steps). Remember how excited everyone got when it was announced a stay on the amazon gateway mobile patent case in order to work out a settlement? Then when it finally came there was no indication that Voip pal received anything of significance from this "settlement". What is worse is that it appears to have had no carryover to the Amazon RBR patent case ie why have they not announced settlement discussions for this patent case as Amazon requests a trial stay in this particular incident. No, the most effective way of obtaining a fair settlement is to hold defendants feet to the coals by setting a trial date and sticking to it IMO. Not to mention the negative effects these trial delays have had on our pps. I once hoped that Albright, the antithesis of Koh, would be our savior and I am still very happy that he is hearing our cases but he is not the same Judge he was before our arrival. The old Albright would never have allowed Meta and Google to be transferred back to NCAL and with all these trial delays and catering to defendants he is not living up to his "Rocket Docket" nomenclature.
