The Supreme Court only opines on constitutional matters and per Tyler v. Hennepin County contract and property rights exist far before the US Constitution but not all that long before it. Maritime, contract, and common law frameworks have a sort of precedence which - if the US Constitution doesn't explicitly delegate it - is not subject to political manifestations like you wish to describe. Your ethical framework is that of an unscrupulous pessimist and will remain so until otherwise proven. Be careful what you wish for, Bradford.
