Lamberths court has no jurisdiction on a takings case and this case did not allege a takings. The cofc has jurisdiction to hear takings but the remedy for a total taking is the market value as of the date of the taking which was way less than 240 billion. An illegal exaction would make for a better case than a takings because of the remedy available.
