WTF
I saw the comment re - no right to elect in kind payment

Where ever the beans spill and land (dilution or ..) ---- my memory is that the payment in kind was spelled out as an optional way for FnF to pay the 10%

I do not understand the overall approval of the taking

For sure I can not see how GOV argues that payment in kind was not available day one

To me - that should have been the method of payment from day one - to preserve actual cash
