Both in response to the very recent action in Federal Court - as in post 75990 ?

I have no idea if this ARGUMENT (and associated) carry water or are a hail mary - but boy I would love to be back at a Taking Case

My sense is Sweeney had her hands tied (putting aside if she is fair or not ----- and my recollection is that she allowed discovery when other judges were killing us at the earlier summary judgement stage)
