it's going to be a Loooong time before it happens... like over a year

Plaintiffs propose that the close of fact discovery be May 17, 2024.
Plaintiffs propose that Initial Expert Disclosures be exchanged on June 17,
2024, that Rebuttal Expert Disclosures be exchanged on July 17, 2024, and
the close of expert discovery be August 16, 2024. Defendants Geoff
Bazegian, Jonathan Bishop, and NNRX do not oppose to Plaintiffs’ proposed
timing for discovery deadlines.

preliminary injunction pending ( could come at any time ) court denied temporary restraining order which is a small win for NNRX

Plaintiffs moved for a Temporary Restraining Order and Order to Show
Cause for Preliminary Injunction. The Court denied the Temporary
Restraining Order. The preliminary injunction issue has been fully briefed, the
Court took the hearing on the issue off calendar, and a decision is pending.

Motion to dismiss is still pending which would be a total win for NNRX

a pre trial settlement is also on the table

The Parties have engaged, and continue to engage, in settlement
discussions to resolve this action. Each side has made multiple offers and
counters, and the parties continue to try and work towards resolution. The
Parties believe that if they are not successful in settling the case themselves,
then private mediation around the close of fact discovery would be the best approach
for formal ADR efforts in this action.

trial won't happen until late 2025
Pretrial Conference and Trial
Plaintiffs propose that the pretrial conference take place on or about
February 20, 2025, with trial to begin on or about April 7, 2025
