BuyBack is a public process. To start with They must announce one before they start, the announcement comes with figures like numbers of shares to buy or $ amount, then they must buy only at the bid and from a specific range of hours, like from 10 am to 3pm or so. plus other steps, DD on that since I forgot the exact procedure.
