It's quite amusing to hear Ackman's position used as a justification for owning FnF common. He made huge bets on Valeant and Herbalife and lost billions.
He has already acknowledged that not only did he buy the juniors because "it hedges our risk of a
restructuring that disproportionately benefits the preferred versus the common shares" (his words), but also that he couldn't do anything about that even though he owns 10% of the common in each company.
