"Lawsuit Filed Challenging Biden Admin Censoring First Amendment Rights Of People Injured by COVID Vaccines":

The New Civil Liberties Alliance (NCLA) is a nonpartisan and nonprofit civil rights group that was founded to protect constitutional freedoms from being violated by state and federal agencies.

NCLA filed a lawsuit on Monday, May 22, 2023, that challenges the Biden administration's efforts to monitor and censor online support groups that deal with people who were injured by the COVID vaccines. The lawsuit names White House Director of Digital Strategy Rob Flaherty, President Joe Biden, White House Press Secretary Karine Jean-Pierre, Secretary of Health and Human Services Xavier Becerra, U.S. Surgeon General Vivek Murthy, and other White House administration staff members.

The lawsuit states that it is essential to free government that the First Amendment be safeguarded “to the ends that men may speak as they think on matters vital to them and that falsehoods may be exposed through the processes of education and discussion.” The lawsuit says that it is not the government’s role to curate, filter, or suppress disfavored speech before it reaches the eyes and ears of American citizens. Yet, that is precisely what happened and continues to happen in this case.

The plaintiffs in the lawsuit are Brianne Dressen, Shaun Barcavage, Kristi Dobbs, Nikki Holland, Suzanna Newell, and Ernest Ramirez. All but Mr. Ramirez have suffered vaccine-related injuries. Brianne Dressen volunteered to participate in the vaccine trials for the AstraZeneca vaccine. Ernest Ramirez did receive the Moderna vaccine without issues, but his 16-year-old son died five days after receiving the Pfizer vaccine. The lawsuit claims that the plaintiffs have all been heavily censored on social media for sharing their experiences and medical research, and they have repeatedly had their speech flagged as misinformation or removed.

NCLA litigation counsel Casey Norman says, “The government claims that it suppresses so-called misinformation for the sake of public safety and welfare. It is the government’s view that Americans cannot be trusted with their own minds and must be shielded at all costs from misinformation, disinformation, and malinformation—which is whatever the government deems it to be. Fortunately, the First Amendment says otherwise: "The government may neither censor our clients nor induce others to do so.”
