only person charged on 14 counts was David Lopez and the jury completely exonerated him.
It’s was a civil matter, so the bar is very low and the SEC failed to prove their case alleging aiding and abetting.
The one remaining count has to do with “omissions” in a 211 filing. The alleged omitted information would have never been seen by the public in the Form 211, but was available on the SEC’s website.
It’s a paperwork error at worst, and hopefully the 11th Circuit sees it wasn’t a 10b violation, nor could it be.
